Frequently Asked Questions - and Answers!

Do you offer a free interview?

No - but we do offer an initial fixed fee interview. Please ask for details by calling 01274 589900.

Do I need to bring anything with me when I come to see you for the first time?

All you need to bring with you is two pieces of identification, one of which confirms your current address. A current passport or photographic driving licence would be ideal together with a recent utility bill confirming your address. In terms of any other papers please feel free to bring with you any paperwork you feel to be relevant to your case and if you have been served with papers please bring these with you too. You are also welcome to bring a pen and notepad if you wish to make some notes.

We have decided to divorce and everything is agreed. Can you represent both of us?

No. Due to our Code of Conduct Rules regarding potential conflicts of interests between parties we are not allowed to represent you both however amicable matters may be. Whilst we appreciate that matters may be agreed between the two of you it is important to ensure that both parties have had the opportunity to seek independent legal advice about the agreement that has been reached and the impact the terms of that agreement has on them personally.

We want to resolve matters amicably. Will solicitors create arguments?

When a relationship breaks down there will may be difficult issues that need to be resolved between the parties. This does not mean however that matters cannot be dealt with sensitively and constructively. Kinsey & Co Solicitors are Accredited Specialists of Resolution (formerly known as the Solicitors Family Law Association) which is an organisation of family solicitors that promotes the need for a sensible and sensitive approach when dealing with family law matters. Any client seeking family law advice should look to see whether their solicitor is a member of Resolution.

Kinsey & Co Solicitors is proud to offer clients the Collaborative Law approach to resolving family law issues arising from the breakdown of the relationship. The Collaborative Law approach is founded on  basic principles of mutual respect and understanding between the parties and their common wish to resolve matters away from the court system. If you feel that the Collaborative Law approach may be of interest to you please read our section regarding Collaborative Law to find out more.

I am worried about legal fees. How much will my case cost?

We cannot provide you with an exact figure as to how much your case will cost. Much depends on the issues involved, the complexity of your case and the approach adopted by the other party towards the case. We will however provide you with an estimate of your likely fees at the outset of your case and will notify you if we have to revise that estimate because the circumstances upon which we provided the original estimate have altered. All clients receive a breakdowns of their charges with their account and six month reviews of each case take place at no charge to the client. Whilst Kinsey & Co Solicitors are not cheap we do consider the bespoke client care service we offer to be good value for money.

I am nervous about coming to see you. Can I bring a friend?

Kinsey & Co Solicitors aim not only to provide excellent legal advice but to provide it in an approachable and friendly manner. We recognise however that coming to see us can be a daunting prospect and therefore clients are welcome to bring a friend or relative along for moral support or simply to provide you with a second pair of ears!
