The collaborative approach to dealing with family law matters emanates from the United States of America. Specially trained collaborative lawyers in the United Kingdom have adapted the process to the English legal system to the enable family law clients in this country to benefit from the many positive outcomes that can arise when couples decided to deal with their relationship breakdown collaboratively.
The collaborative approach is based on each party having a mutual respect for the other and a shared determination to resolve their issues away from the law courts. Both parties and their respective collaborative lawyers sign a Participation Agreement which sets out the ground rules for future negotiations. Negotiations take place in a series of Four-Way meetings with both parties and solicitors present with the parties agreeing an agenda prior to each meeting.
Experience shows that the Collaborative Law approach enables clients to deal with the legal and emotional issues that arise from the breakdown of their relationship with the help and support of their collaboratively trained lawyers and to resolve financial issues and children issues in a way that suits the needs of their family best.
